Terms and Conditions of Sale
The owner of the online store www.lashweb.eu (hereinafter the Online Store) is Paist Trading OÜ (registry code 14643766), located at Vetevana tee 8, Rannamõisa village, Harku municipality, Harju county, 76906.
1. General Provisions
1.1. These Terms and Conditions apply to purchases made in the Online Store. The Terms govern all legal relationships arising between any person (hereinafter the Buyer) and the Online Store when purchasing goods.
1.2. The Online Store has the right to unilaterally amend and supplement the Terms by publishing the new Terms at www.lashweb.eu/muugitingimused. If the Buyer placed an order before the amendments took effect, the legal relationship between the Buyer and the Online Store is governed by the Terms in force at the time the order was placed.
1.3. Acceptance of the Terms is required to place an order. By submitting an order and making payment, the Buyer confirms that they have understood and agree to the Terms.
1.4. If any provision of the Terms is void or invalid, this does not affect the validity of the remaining provisions.
1.5. In addition to these Terms, purchases from the Online Store are governed by the laws of the Republic of Estonia.
2. Product and Price Information
2.1. Information about the goods is provided next to each product in the Online Store.
2.2. The prices of products sold in the Online Store are indicated next to the products. All prices are in euros and include VAT.
2.3. The price is supplemented by a delivery fee. The delivery fee depends on the Buyer’s location and the chosen delivery method. The delivery fee is displayed to the Buyer during checkout.
2.4. The Online Store reserves the right to adjust prices. If the Buyer submitted the order before a price change took effect, the price shown on the invoice at the time of ordering applies. The Buyer is not entitled to claim compensation for any price difference.
2.5. The Online Store has the right to withdraw from a sales transaction and demand the return of goods if, due to an error, the price of the goods in the Online Store was indicated significantly below the market price.
3. Placing an Order and Validity of the Sales Contract
3.1. To order goods, add the desired products to the shopping cart. To check out, fill in the required fields and select a suitable delivery method. The total amount will then be displayed, which can be paid securely via bank link using the following payment service providers: Swedbank, SEB, Luminor, LHV Pank, Coop Pank, Citadele, Revolut, N26 Bank, Apple Pay, Google Pay, or credit card.
3.2. Payments are mediated by Montonio Finance UAB and Shopify Finance. Payment is made outside the Online Store in a secure environment.
3.3. Payment by invoice is available to business customers only.
3.4. The sales contract is deemed concluded and order processing begins as soon as the total amount due has been received in full to the Online Store’s bank account.
3.5. After placing the order and making the payment, an order confirmation will be sent to the Buyer by e-mail.
3.6. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the Buyer will be informed at the earliest opportunity and the amount paid (including delivery costs) will be refunded promptly, but no later than within 14 days from the date of notification.
4. Delivery
4.1. Goods are delivered within Estonia and Finland. The goods will be delivered to the address provided by the Buyer during checkout.
4.2. Goods are shipped to parcel lockers and by courier. The Online Store’s delivery partners are Itella Estonia OÜ, AS DPD Group and Omniva OÜ.
4.3. Delivery times shown in the Online Store apply from the moment the invoice is paid.
4.4. The avoidance of delays and misunderstandings in delivery depends on the accuracy of the information provided in the order. The Buyer must promptly notify the Online Store of any changes to the destination or agreed delivery time.
4.5. The Online Store will replace products damaged during delivery if their proper use is not possible. If replacement is not possible, the Online Store will refund the amount paid for the damaged products.
5. Right of Withdrawal
5.1. After receiving the order, the Buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
5.2. The right of withdrawal does not apply if the Buyer is a legal person.
5.3. Returned goods must be unused, undamaged, and in the original packaging.
5.4. If the goods have been used for purposes other than those necessary to determine the nature, characteristics and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.
5.5. The direct costs of returning the goods are borne by the Buyer, except where the reason for return is that the product does not correspond to the order (e.g., wrong or defective product).
5.6. To return goods, the Buyer must submit a simple withdrawal notice and send it to info@lashweb.eu no later than within 14 days from receiving the goods. The withdrawal notice must include the Buyer’s name, the product name, and the order number.
5.7. The Buyer must return the goods within 14 days after submitting the withdrawal notice or provide proof that the goods have been handed over to the carrier within the aforementioned period.
5.8. Upon receiving the returned goods, the Online Store will promptly refund to the Buyer all payments received under the contract, including delivery costs borne by the Buyer, but no later than 14 days from receiving the withdrawal notice.
5.9. If the Buyer has expressly chosen a method of delivery other than the least expensive standard delivery offered by the Online Store, the trader is not required to refund the additional costs exceeding those of standard delivery.
5.10. The Online Store may withhold the refund until it has received the goods back or the Buyer has provided proof of having sent back the goods, whichever is earlier.
6. Complaints and Liability
6.1. The Online Store is liable for any lack of conformity or defect in goods sold to the Buyer that existed at the time of delivery and that becomes apparent within two years from delivery to the Buyer. Within the first year from delivery, it is presumed that the defect existed at the time of delivery. It is the Online Store’s responsibility to rebut this presumption.
6.2. In the event of a defect, the Buyer must notify the Online Store no later than within two months by sending an e-mail to info@lashweb.eu.
6.3. The Online Store will respond to the consumer’s complaint in writing or in a reproducible form within 15 days.
6.4. The Online Store is not liable for damage or any other consequences arising from incorrect data provided by the Buyer when fulfilling the order, including delivery delays, if these are due to circumstances beyond the Online Store’s control or foresight.
6.5. The Online Store is not liable for defects that occurred after the goods were delivered to the Buyer.
6.6. The Online Store is not liable for damage caused by improper use of the goods.
6.7. If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is impossible, the Online Store will refund to the Buyer all fees paid under the sales contract.
6.8. The Online Store is liable to the Buyer, and the Buyer is liable to the Online Store, for damage caused to the other party by a breach of these Terms in the cases and to the extent provided by the laws of the Republic of Estonia.
7. Dispute Resolution
7.1. If the Buyer has any complaints regarding the Online Store, they should be sent to info@lashweb.eu.
7.2. Disputes arising between the Online Store and the Buyer will be resolved by negotiation.
7.3. If the Buyer and the Online Store are unable to resolve the dispute by agreement, the Buyer may contact the Consumer Protection and Technical Regulatory Authority’s Consumer Environment Department (https://www.ttja.ee) and the Consumer Disputes Committee (http://www.komisjon.ee) for out-of-court dispute resolution, or the courts.
7.4. The Buyer may also use the European Union’s Online Dispute Resolution platform (http://ec.europa.eu/odr).
8. Direct Marketing and Processing of Personal Data
8.1. Processing of the Buyer’s personal data is carried out in accordance with the Online Store’s Privacy Policy, available here.
8.2. By placing an order, the Buyer consents to the processing of their personal data for the purpose of fulfilling the order.
8.3. The Online Store uses the information provided by the Buyer solely for fulfilling the Buyer’s order and delivering the goods to the Buyer and does not disclose it to third parties.
9. Copyright
9.1. All content of the Online Store (including photos and texts) is protected by copyright, and unauthorized copying or printing is prohibited under the Copyright Act.
9.2. Use of the Online Store’s content is permitted only with the prior written consent of Paist Trading OÜ.
